Just last week the U.S. Senate <a href="http://www.rcfp.org/newsitems/index.php?i=11492">unanimously passed</a> the SPEECH Act, protecting American journalists, authors, and publishers from the enforcement of frivolous libel suits filed in countries that do not have our strong free speech protections.

Yesterday, the bill went to the U.S. House and <a href="http://www.sourcews.com/house-passes-cohen-speech-act">quickly passed</a> with bipartisan support. The legislation is now on its way to President Obama's desk, to be signed into law.

Dr. Rachel Ehrenfeld, who fell victim to a libel suit in the U.K., has steered a national campaign to end libel tourism for the past two years. Ehrenfeld's story, told in MPI's film <em><a href="http://www.thelibeltourist.com/">The Libel Tourist</a></em>, prompted the New York legislature to take action. Since 2008, several other states have followed suit, including Illinois, Florida, California, Tennessee, Maryland, and Utah. The SPEECH Act is the culmination of her national effort. 

What's more, the effort is being echoed abroad. Britain has been feeling the pressure for quite some time to re-examine its libel laws, and has now <a href="http://www.editorsweblog.org/newsrooms_and_journalism/2010/07/the_us_speech_act_puts_pressure_on_uk_li.php">stated its plans</a> to draft a revised libel tourism bill for March of next year.

Ehrenfeld has graciously acknowledged how <em>The Libel Tourist</em> has had a significant role in raising public awareness about foreign threats to free speech. "Thor Halvorssen, the Moving Picture Institute, and Jared Lapidus' film have been most helpful in this important struggle to protect and defend our First Amendment rights." <em>The Libel Tourist</em>, she says, "is a masterpiece, and should be viewed by every American and by freedom-loving people worldwide."]]>

Now, the <a href="http://www.rcfp.org/newsitems/index.php?i=11492">U.S. Senate has unanimously passed</a> the SPEECH Act, which will uphold First Amendment provisions for American authors and publishers, protecting them from the enforcement of frivolous libel law suits filed in countries that do not have strong free speech protections. Senator Patrick Leahy commented:

<blockquote>"The freedoms of speech and the press are cornerstones of our democracy...They enable vigorous debate, and an exchange of ideas that shapes our political process. Foreign libel lawsuits are undermining this informational exchange. While we cannot legislate changes to foreign law that are chilling protected speech in our country, we can ensure that our courts do not become a tool to uphold foreign libel judgments."</blockquote>

Ehrenfeld has been enthusiastically committed to ending foreign libel suits and protecting Americans abroad, and she praised the passage of the bill, which she said "protects all Americans in the uninhibited, robust, and wide-open manner that the First Amendment was designed to guarantee." She has also graciously acknowledged the vital role <em>The Libel Tourist</em> played in raising public awareness about these foreign threats to free speech.       <![CDATA[<a href="http://www.usatoday.com/news/education/2010-06-30-edufilms30online_ST_N.htm"><i>USA Today</i></a> has dubbed 2010 the "year of the education documentary," and cites <i>The Cartel</i> as a vital part of bringing ideas about education reform into the mainstream. This is a good thing--good for public awareness, good for our national debate about our failing schools, and good for the prospects of kids, who need better educational options if they are to have the futures we would like them to have.

But the teachers unions don't agree. <a href="http://www.heartland.org/full/27968/NEA_Weighs_Campaign_Against_ProReform_Films_Charter_Schools.html">Earlier this month</a>, at the annual meeting of the National Education Association, delegates considered a proposal to spend $3.5 million on a publicity campaign to "counter the media propaganda" of "anti-teacher union" documentaries, naming <i>The Cartel</i> and the other hard-hitting films that are currently challenging how we approach--and fund--public education in this country. 

Accusing the filmmakers of telling lies and of being "secretly" funded by special interest groups, the measure was factually inaccurate and riddled with ad hominem attack. And while it was defeated, the fact that it was considered at all sends a strong message about the NEA's openness to constructive discussion about how we might improve education for all children in this country. 

"They should get their facts right," <i>Cartel</i> director Bob Bowdon said. "This movie was funded entirely by myself. I only accepted distribution money after the movie was finished and had already been shown at a film festival, where it won an award. ... Ad hominem attacks have been the union's favored approach because they ignore the argument of the movie, which is very simply that consumer choice works in every other aspect of our lives, so why would it not work in K-12 education? It certainly works in higher education."

The NEA--which numbers over 3 million dues-paying members--also considered a proposal to spend $25 million on a documentary opposing charter schools. It was voted down. But that doesn't mean the union is dropping the issue. What did pass: a measure directing the NEA and its affiliates "to expose and educate the media and the public about allegedly grassroots, pro-charter 'parent groups' that are popping up with greater frequency on both the national and local level."

"Exposure" and "education" are wonderful--as long as they are accurate, conducted with transparency, and handled as part of a free-wheeling, unfettered debate. Let the best ideas win!]]>

Write an unfavorable mention of someone and you could be defending yourself in a British court, where the absence of critical free speech provisions inadvertently triggers senseless libel law suits. These "victims" of published material exploit the system to file suit in countries where laws are most favorable to them and least protective of writers, including Britain among others. Widely known as libel tourism, this practice has become a major hindrance to free speech for Americans that distribute books or articles within the U.K.
 
Released in 2007, MPI's short film <a href="http://www.thelibeltourist.com/"><em>The Libel Tourist</em></a> tells the story of Rachel Ehrenfeld who fell victim to one such libel suit. Her case and other recent cases have forced Americans to take a closer look at this problem. Motivated by Ehrenfeld's experience, New York state enacted "Rachel's Law" in 2008 to ensure First Amendment provisions for New York writers. Other states like California, Louisiana, Florida, and Illinois have <a href="http://www.nytimes.com/2009/05/26/opinion/26tue2.html">taken the same measures.</a>

Inspired by New York's actions, Members of Congress introduced 2009 The Free Speech Protection Act, which was passed in the House and is now <a href="http://au.news.yahoo.com/a/-/technology/7444359/us-lawmakers-target-libel-tourism/">in front of the U.S. Senate Judiciary Committee</a>. This legislation would shield American authors and publishers from suits filed in countries that do not have our strong free speech protections, and bring justice to those subject to such radical scrutiny.]]>

<li><strong>Tuesday, June 29</strong> - <strong><em>The Cartel</em> screens today at the <a href="http://www.nationalcharterconference.org/">2010 National Charter School Conference</a> in Chicago.</strong> The screening will be at 3:45pm in the theater E350. This conference features a keynote speech from Bill Gates, among other special guests.</li>

<li><strong>July 31 - August 7</strong> - <em>The Cartel</em> has been selected to screen at the <a href="http://www.burbankfilmfestival.org/">Burbank International Film Festival</a> in early August. Updates on the date and time of the screening will be available soon.</li>

<li><strong>August 12</strong> - <em>The Cartel</em> will screen at the <a href="http://outrageconference.com/agenda/">Where's the Outrage conference</a> on school choice. Director Bob Bowdon and Thor Halvorssen, MPI's founder, will speak at the conference, and several education policy experts will be in attendance.</li>

<li><strong>August 26</strong> - <em>The Cartel</em> will screen at the <a href="http://defendingthedream.org/beta/">Defending the American Dream Summit</a> hosted by Americans for Prosperity. <em>Do As I Say</em> will also be featured; both films will play on opening night from 5:00-8:00 p.m. </li>

      <![CDATA[<em>The Cartel</em> isn't the only education reform film making waves this year. Other films such as <a href="http://thelotteryfilm.com/"><em>The Lottery</em></a> and <a href="http://www.waitingforsuperman.com/"><em>Waiting for Superman</em></a> are also making the case for sweeping reform. These films are bringing to light issues that Hollywood for years has refused to address. 

Conn Carroll at <a href="http://blog.heritage.org/2010/06/08/is-hollywood-turning-on-teachers-unions/">Heritage</a> writes:

<blockquote>...politicians are not the only ones questioning their old labor allies. Hollywood, who has long been ally of teachers unions (witness the 1998 Rob Reiner funded Proposition 10), is also beginning to notice. Over the past year, three new documentaries <em>The Cartel</em>, <em>Waiting for Superman</em>, and <em>The Lottery</em> have all taken critical looks at our nation's public school system and produced damning indictments of teachers unions.

Bob Bowden, who produced and narrated <em>The Cartel</em> says in the movie:

<blockquote><em>"Those good teachers deserve our respect. Wanting lousy teachers out of the classroom doesn't mean you're against all teachers. A point so obvious, I can hardly believe it needs to be made. This absurd idea that you have got to support every teacher, or else you hate all teachers, has been an effective myth put forward by the union for years."</em></blockquote></blockquote>

      <![CDATA[After a previously sold out show in April, <em>The Cartel</em> returned to Westfield, New Jersey this week -- and audiences loved it. 

The <a href="http://westfield.patch.com/articles/cartel-comes-to-westfield-again"><em>Westfield Patch</em></a> writes:

<blockquote>Viewers came from all over the area: Edison, Newark, even New York City.

"We had a good showing in Westfield last time," said Bowdon. "We sold out last time, so that's why we wanted to come back."

[...] The audiences laughed, gasped and hissed along with the film, and engaged in spirited discussion with Bowdon when he asked for questions.

"The Cartel" calls for nationwide education reform, using examples mostly from urban New Jersey schools. The film illustrates the high spending and poor performance of many district schools, the dominance of teachers' unions have on New Jersey politics and the demonization of school vouchers and charter schools. The audience seemed to respond well to the film, with many members prefacing their questions with comments expressing support. The comments were similar to those from the first screening in Westfield.

"People register outrage when they see this film," he said.</blockquote>

Outrage indeed! <em>The Cartel</em> is getting that reaction all over the country. More screenings are being added and the DVD will be available in August or September. Don't miss this film!
